
On 29 March 2019, the revised Immigration Rules permit students to register for Tier 2 in the U.K. 3 months before the planned completion date of their training. You must apply from the United Kingdom to apply for your new Tier 4 visa before the expiry.
FACTORS TO TAKE INTO ACCOUNT WHEN CHANGING
To meet the Tier 2 (General) requirements, you must have left or remain in the Tier 4 migrant category, be supported by an international higher education institution in the United Kingdom, or have obtained prior permission to perform a short-term thesis in the United Kingdom. Please keep in mind that only Tier 4 sponsors who meet the applicable requirements will be eligible.
EDUCATION ELIGIBILITY
For eligibility, the following credentials have to be obtained or completed:
- The U.K. recognized Bachelor degree;
- The U.K. recognized Master degree;
- K. Postgraduate Certificate of Education;
The Home Office does not consider different credentials. Therefore, it is necessary to verify that the Home Office accepts your qualification.
CALENDAR
If you have finished or complete the above qualification (excl. the UK Ph.D.), You may apply for a Tier 2 visa over the next three months (General). You will be eligible to apply if you have studied in the United Kingdom since your last stay in the UK for a minimum of 12 months.
You must study or take the classes as mentioned above, in your last bursary, or “a consistent time of leave that contains your final bourses.” We will help inform you whether your leave is deemed to be permanent or breakdown. For those with a Bachelor’s or Master’s, this could be important and may accompany this with postgraduate studies such as the LPC or the BPTC. This is important.
STUDY PERMIT
During your study time in the U.K., you must not be subject to any conditions, and you must take a legitimate leave. A significant thing to remember is that you need to take the training of Tier 4 and that depending on the additional research done by the sponsor of Tier 4 is not necessary.
SCHOLARSHIP
If you are sponsored by a country or an international scholarship organization, you will have to respect different conditions.
Tier 2 (general) implementation requirements from the U.K.
You must be given a position at the required level with the appropriate wage before applying for a Tier 2 visa.
AGE
You must be 16 years old at least. If you are under 18 years old, your parents’ permission would normally be required by the home office.Certificate of Sponsorship (‘CoS’).
You will need a Tier 2 sponsor permit from a U.K. employer before applying for a Tier 2 visa. If you have no sponsor license, you need to apply for a sponsor license. Different records are requested, and tasks are required. We suggest you take legal counsel from your boss about how to apply for a sponsoring license. You should also be mindful that most sponsor license applications can be approved in under eight weeks and should consider this when you decide to apply for a Tier 2 visa.
Your sponsor will grant a certificate of sponsorship to you with a Tier 2 sponsor license.
It is necessary to remember that issuing a CoS does not mean that your Tier 2 (General) framework application is successful. Other essential criteria do have to be met. For more assistance, you may need to provide legal counsel.
LABOR MARKET RESIDENT TEST
The sponsor can need a Resident Labour Market Test (“RLMT”) in most applications before they can award you the job, including a C.S. This is the measure where you have to announce the appointment in two appropriate locations for 28 calendar days.
If the candidates satisfy the applicant’s conditions, the sponsor may be exempted from carrying out an RLMT.
LANGUAGE OF ENGLISH
This condition can be met in a variety of ways, including:
- Getting the required English language tests.
- To get an English degree.
- You are an English-speaking national in plurality.
Please notice that your submission will be rejected even though you follow all the other conditions if you cannot fulfill this condition.
MAINTENANCE
This condition will be met if savings are held for at least £945 for a consecutive 90 day period, not until 31 days previous to the submission date. This requirement must be met. Your company should also attest to CoS that it will keep and accommodate you until the end of your first month in the U.K.
TRAVELLING
Applicants wishing to fly after completing their Tier 4 visa studies should be mindful of their possible challenge before joining the U.K. when sending Tier 2 applications. You will have to be assured to prolong your leave in this or any rank, or you leave your new Tier 4 visa before expiry. The immigration officer will have to be pleased.
You do not fly until you have received a decision after submitting your Tier 2 submission, and wait until your latest B0RP has been received is to be recommended.
